Welcome to MAHA Global (“Maha”), a platform dedicated to enhancing your workplace by unlocking the purpose capabilities within your team. This Privacy Policy will outline and explain the manner in which Maha obtains, uses, and shares, the information that end users (“End Users”) submit through the Maha platform (the “Platform”). As a condition to access our Platform, you hereby accept the terms and conditions and practices described in this Privacy Policy, as well as our Terms of Use, which are incorporated by reference into this Privacy Policy. If you see an undefined term in this Privacy Policy (such as “Services”, “Account”, or “Platform”), it has the same definition as outlined in our Terms of Service.
WHAT INFORMATION IS COLLECTED?
MAHA provides companies (“Employer”) the means to survey its team members (End Users) and receive anonymized and aggregate feedback from within. In other words, the purpose of the Platform is for End Users to feel comfortable and secure in sharing their feedback on the workplace, and for the Employer to receive said feedback in a way that does not identify the End User itself. To those ends, the Platform will only collect the following information from End Users:
- User Input: Through the Platform’s experience, End Users will be able to provide input and feedback through a number of forms and queries (“User Input”). Maha will store the User Input and provide the same to the Employer. While the User Input may be aggregated, and it will not bear the End User’s name, it will be provided as is to the Employer. As such, End Users must be aware that if they identify themselves in the User Input, then the Employer will receive said information as is.
WHAT INFORMATION IS NOT COLLECTED?
MAHA will not ask for, and End Users should not provide, any of the following information:
- Names
- Birth date
- Addresses, be it former or current
- Medical information
- Family information
- Any other identifiable information
However, if the End User submits any of this information through an User Input, then Maha may share said information with the Employer as part of its aggregated deliverables through the Platform.
WHERE WILL MY INFORMATION RESIDE?
The Platform runs on Maha’s secure servers, and as such, all data and information processed through the Platform is stored there. Employers will not have access to Maha’s servers, nor to the data as it is stored in our servers.
As described in this Privacy Policy, Maha may sometimes share your information within our company or an affiliate company, as may be created from time to time, or with third parties (subject to this Privacy Policy). When you use the Platform, you authorize us to transfer, store, and process your information in the United States and possibly other countries. Laws in these countries may differ from the laws applicable to the place where you live. For example, information collected within the European Economic Area may be transferred, stored, and processed outside of the European Economic Area and in the United States for the purposes described in this Privacy Policy. By using our Site and Services, you consent to transferring your data from your home country to the United States.
WHAT INFORMATION WILL BE SHARED?
Maha takes the User Input and aggregates it with that of other End Users from your team (“Aggregated Data”), to then provide the Aggregated Data to your Employer. Maha’s unique algorithm for creating the Aggregated Data aims to minimize the chances for the User Input to identify a certain individual by only aggregating data once a critical threshold of User Inputs is met. However, Maha is not responsible for any specific User Input that provides sufficient information to identify its author.
Maha will not share your name, nor your User Input, with any third parties, except as provided later on in this Privacy Policy. Maha will not share your email address with third parties. Maha will only use your data (name, email, User Input), to provide the services through the Platform.
WHAT ABOUT NON-IDENTIFIABLE INFORMATION?
Maha may, from time to time, collect certain non-identifiable information (“NII”), such as what internet browser you use, what computer make you have, or your general location as provided by your IP address.
Maha may sometimes install small data files, known as cookies or web beacons, on End User’s devices. A cookie is a small text file that websites install on the computer or mobile device of users who visit them. Cookies make it possible for the website to remember user actions and preferences (login ID, language, font size, and other display preferences) so that it does not have to be reconfigured when you return to the site or browse through its respective pages.
Although cookies are not essential for the Site to work, if you enable them you will enjoy a better browsing experience. You can delete or block cookies, but if you do, some of the features on this Site may not work properly. The information associated with cookies is not used to personally identify the user. These cookies are used exclusively for the purposes indicated here. You can control or delete cookies whenever you want. For more information, see http://www.aboutcookies.org. In addition to being able to remove all cookies already on your computer, you can also configure most browsers to stop accepting them. But keep in mind that if you reject cookies, you may have to manually reconfigure your preferences each time you visit a site and that certain features and services cease to function.
Web beacons are used to improve your experience on our Service. A web beacon may be a single-pixel (1×1) or clear GIF. Web beacons recognize certain types of information on your computer such as cookies, the time and date when a website has been visited, and a description of the page where the web beacon is placed.
This NII will only be used for Maha for internal purposes and will not be shared with third parties or your Employer. Maha may use any of the above mentioned NII (including beacons and cookies) to remember, without limitation:
- Your presentation preferences (for example, contrast, color, or font size).
- If you have already responded to a pop-up questionnaire about the usefulness of a particular content (not to ask you to do so again).
- Whether or not you have given your consent to use cookies on the Platform.\
- Generate and review reports and data about our user base and service usage patterns;
- Improve the quality of the Platform through the performance of quality reviews and similar activities;
- Prevent, detect, and investigate potentially prohibited or illegal activities, and enforce the Terms;
- Compile aggregate data for internal and external business purposes and create aggregate statistics and reports relating to the use of the Platform;
- Notify End Users when updates are available;
- Market and promote the Platform, and analyze the accuracy, effectiveness, usability, or popularity of the Platform;
- Resolve disputes and troubleshoot problems;
- Provide you with other services requested by you as described when Maha collect the information;
- and take any other action as otherwise stated in this Privacy Policy or the Terms or for which you give us authorization.
WHAT ABOUT MINORS?
Please note that Maha do not knowingly store, collect or maintain user information for persons under the age of eighteen (18) years of age. If it comes to our attention that Maha have inadvertently received information from a person under eighteen (18) years of age through the Plaform, Maha will delete that information from our records.
- Generate and review reports and data about our user base and service usage patterns;
- Market and promote the Websites and the Service, and analyze the accuracy, effectiveness, usability, or popularity of the Service;
- Resolve disputes and troubleshoot problems;
- Provide you with other services requested by you as described when we collect the information;
- and Take any other action as otherwise stated in this Privacy Policy or the Terms or for which you give us authorization.
This information also helps us measure the performance of our Services allowing us to continually improve. The information provided can also help us in the detection of fraud, abuse and other behavior.
We may use your information for internal purposes related to research and development; to make business decisions; or to improve or develop our service and / or products. In addition, your information could be used to generate statistical reports or analysis.
DISCLOSURE OR SHARING INFORMATION WITH THIRD PARTIES
Unless otherwise provided in this Privacy Policy, Maha agrees to keep all information secure and will not disclose it for any other matter.
We may disclose your information if a government agent or law enforcement agent makes an application, as long as it complies with applicable law.
We may transfer, assign, rent or sell your information to third parties in connection with events outside our ordinary business practices, including, without limitation, the sale, merger, consolidation, change of control, transfer or sale of assets, reorganization or liquidation.
We may share or disclose your information to our affiliates and / or those entities or persons with whom We have entered into agreements to (i) perform functions or services relating to the operation, administration and maintenance of the Platform (including but not limited to service providers for web hosting, programming or applications); or (ii) the processing of collections and payments of transactions made through the Platform.
Information shared with affiliates or third parties will be subject to their privacy policies
To the extent permitted by law, we may share your information with law enforcement, governmental agencies, or authorized third parties, in response to a verified request relating to a criminal investigation or alleged illegal activity or any other activity that may expose us, you, or any other End User of the Platform to legal liability, or to protect our rights or property, or during emergencies when safety is at risk. We may also share your information in response to court orders, subpoenas, or other legal or regulatory requests, and we may provide access to your information to our legal counsel and other consultants in connection with actual or potential litigation.
“DO NOT TRACK” SIGNS
Maha may track your online behavior by using technology to increase the effectiveness of the ads or content provided on the Platform. Examples of online behavior that can be traced include response to queries or announcements, websites being visited, and content accessed.
Currently, some browsers offer their users the option of selecting the “do-not-track” option in their configuration. These browsers, in turn, transmit signals to the websites with which the browser communicates. To the extent that there is no uniformity in the industry with respect to the use of this type of technology, for the moment We will not assign value or meaning to “do-not-track” signals and We will not respond to them.
CONTROL OF INFORMATION
We can offer mechanisms that will allow you to correct or eliminate the information you have provided, namely your name and email address. You must access, correct or delete the information that you provide as part of your registration through the mechanisms available on the Platform. If you wish to delete the information that has been collected, you can do so by sending an email to privacy@maha.global, while noting that this will not affect any Aggregated Data that has been shared with your Employer.
CALIFORNIA RESIDENTS
California law indicates that organizations should disclose for California residents whether certain categories of information are collected, made available to third parties in exchange for valuable consideration (“sold”) or disclosed for an organization’s “business purpose” as those terms are defined under California law. However, neither Maha nor your Employer will sell any of your information as provided for in this Privacy Policy.
USER OPTIONS
End Users may at any time opt-out the authorization you have given us to use your information to provide or send you information about the Platform. You can exercise this option by deactivation your Account.
Further, and without limitation, End Users have the following rights at your disposal:
- Right of access – you have the right to request a copy of the data that we hold about you.
- Right of rectification – you have a right to correct data that we hold about you that is inaccurate or incomplete.
- Right to be forgotten – you can ask for the data we hold about you to be erased from our records.
- Right to restriction of processing – you can ask for us to restrict the way we process your data.
- Right of portability – you have the right to have the data we hold about you transferred to another organization.
- Right to object – you have the right to object to our processing your data where we are relying on a legitimate interest in order to process it.
- Right to withdraw your consent – you have the right to withdraw your consent at any time.
Please note that these rights are not absolute and certain exemptions apply.
CHANGES TO PRIVACY POLICY
Maha reserves the right to amend, modify, add to, and/or replace at any time, this Privacy Policy, in whole or in part. Prior to any such modification, we will inform End Users of the same with at least thirty (30) days before the effective date of the changes. We will also notify you of material changes to this Privacy Policy by sending you an email at least thirty (30) days before the effective date of the changes to the email address you most recently provided to us. Continued use of the Platform following notice of such changes will indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes. If you do not agree to the new terms, you may terminate your Account within the applicable thirty (30) day period by contacting us or by deleting your Account from the Platform.
MISCELLANEOUS
If any provision of this Privacy Policy is declared null and void, unlawful, unconstitutional or otherwise without legal effect, in whole or in part, by a competent court, the remaining provisions will remain valid and will continue to bind the parties to all legal effects.
YOUR ACCESS, USE, VISIT OR TRANSACTIONS MADE ON OR THROUGH THE PLATFORM, AS WELL AS ANY DISPUTES RELATED TO THE PRIVACY OF YOUR INFORMATION, IS SUBJECT TO WHAT IS ESTABLISHED IN THIS PRIVACY POLICY AND THE TERMS OF USE OF THE PLATFORM, INCLUDING, BUT NOT LIMITED TO, THE APPLICABLE LAWS, INDEMNIFICATION AGREEMENTS AND RELEVANT RULES SET FORTH THEREOF.
